Rights of Forensic Medical Expert
- To get acquainted with the case materials to make notes to draw a conclusion before the beginning of sitting.
- To put a petition for granting additional materials to him, if such materials are necessary for drawing the conclusion.
- To put questions to court, the defender, the accused, the witness.
- To consult experts of all medical branches, with highly skilled experts.
- The expert, unlike the witness, stays in the court room during the whole period of sitting.
Duties of Forensic Medical Expert
- To be on call of the person making inquiry, the investigator, the public prosecutor and the court.
- To draw the objective conclusion on the question raised to him.
- To carry out the expert research, present the conclusion in written form & sign it.
- As the fiduciary, to keep the data of the investigation.
Responsibility of Forensic Medical Expert
The expert carries criminal liability in following cases :
- Refusal of expert to perform his duties.
- Disclosure of information in period of investigation.
- Knowingly false testimony.
Expert can refuse to carry examination in following cases
- If the expert is the victim or witness.
- If the expert is a relative of victim.
- If the expert if involved in case(Directly or indirectly).
- If the expert has been a subordinate of the accused.
