
Going anonymous, since this case is well known in my town. I had a client who hired me after she was claiming to have been the victim of domestic violence by her husband. She is seeking a divorce and wants to use the domestic violence as the main focus so that she can seek as much as possible in monetary and property assets.
So, I am interviewing her in my office and I ask her routine questions. I then ask her what transpired right before her husband slapped her in the face. She tells me that she was having an affair with her husband’s co-worker, but her husband had no idea at the time. She came home late and her husband was upset and began asking her repeatedly where she was all of this time. She didn’t say a word to him and simply walked up to her husband and kissed him passionately. Her husband pushed her away to find that she had just put semen in his mouth. She then tells him that she just gave his co-worker a blowjob as he was driving her home and that she wants a divorce. He immediately became enraged and open hand slapped her in the face. He was arrested on a domestic violence charge.
None of this was on the arrest report. I personally believed she should have been charged with at least a misdemeanor for the transmission of seminal fluid, but this never happened. I was actually personally siding with the husband at this point and in good faith could not represent this woman. I met with the presiding judge and without stating specifically why I could not represent her, I was allowed to drop her as a client.
